Thomas Newton Lipham

BILL LIPHAM whose great great grandpa was a brother to Thomas Newton LIPHAM who married Lucinda CARPENTER supplied the following information.    See "NOTE" below.
"I don't know if this is correct or not.... I have been researching for about 20 years now. First 10 were just haphazard and when time permitted as I was working, but ever since i retired 10 years ago, I have been trying to get these files "straightened out", but it is a tedious and time consuming process trying to follow up on leads, statements, etc.  I find that a lot of them are contridictory so that is another thing that "holds me up". Oh  well Maybe one of these days something might fall i n place (doubt it but am trying to be optimissic (SP?).  No, I haven't sent anything to anyone except my "relatives".  Have seen many occasions where some of  the recipients of information turn around and "send" this information to people who then charge other people to join their websites in order to get the information which was initially submitted free.  I am in contact with quite a few relatives and between all of us, we have exceeded in what we thought we could find out."

NAME: Went by Mattie. Mattie was listed in the 1920 census as head of household and daughter, Beatrice age 35 single, lived with her. She listed her parents place of birth as United States.  Mattie died in Lineville and was once thought buried at the Macedonia Church.

BURIAL: Martha J. Teague Johnson, wife of Zachariah Thomas Carpenter, was buried at  Concord Baptist Church, Lineville, Clay Co., AL, not at Macedonia Church.  Her tombstone reads "Mrs. Z. T. Carpenter."

I found this yesterday at the courthouse.  It is the probate of the estate of Z.T. Carpenter who is the son of James Warren Carpenter, Sr., and Sarah Abigail "Sally" Harlen.

"State of Alabama, Clay County.  Probate Court, February Term, 1910,  February 12, 1910.  To Hom. F. J. Ingram, Judge of Probate of said County:    Your petitioner, M.T. Carpenter, showeth unto your Honor the following facts:
"1.) That she is over the age of twenty-one years, and is a bona fied resident of the State of Alabama, in said County.
"2.) That she is widow of Z. T. Carpenter, deceased, who died on or about the 10th day of August, 1908, and at the time of his death was a resident of this State and resided in said Conty, and that he left surviving him at the time
of his death your petitioner, his widow, and one minor child, to-wit: Irene Carpenter, who was at the time of his death 17 years of age.
"3.) That the names, ages, and residence of the other children and heirs at law of said Z.T. Carpenter, deceased, are as follows, to-wit: J. W. Carpenter, R. L. Carpenter, H. O. Carpenter, W. E. Carpenter, M. E. Carpenter, G. C. Carpenter, and Z. T. Carpenter and Beatric Carpenter who each reside in Clay County, Alabama and are 21 years of age.
"4.) Your petitioner further shows unto your Honor that said Z.T. Carpenter, deceased, has been dead more than sixty days prior to this date, and that no administration on his estate has been granted, and that he died seized and
possessed of the following described real estate, to-wit:
"The S. 1/2 of S.W. 1/4, and the N.W. 1/4 of S.W. 1/4 less 5 1/2 acres on west side of said last named 40 in Sec. 21, T. 19, R. 8, also 13 1/2 acres on ______ side of N. 1/2, S.E. 1/4 of S.E. 1/4 Sec. 20, T.X. 19, R. 8 less 6
acres on above described land heretofore deeded to the A.B. & A. Railroad Company for right-of-way, all in Clay County, Alabama.
"Your petitioner further shows unto your Honor that the said Z. T. Carpenter and his family, at the time of his death, resided upon said above described land as his homestead, and that said lands constituted all the real estate
owned by said Z. T. Carpenter at the time of his death, and that it is less in area than 160 acres, and in value Two Thousand ($2,000) Dollars, and that your petitioner and her said minor child Irene Carpenter, are entitled, under
the Laws of Alabama, to said property as a homestead exemption as the widow and minor child of Z. T. Carpenter, deceased.
"THE PREMISES CONSIDERED, your petitioner prays that your Honor will appoint two commissioners to appraise and set apart said real estate as exempt to her and her said minor child, Irene Carpenter, to estimate the value of same, and make return of such appraisement and their action in setting same apart, to this Court within ten days as required by law, and that your Honor will make all necessary orders and decrees in the premises necessary and proper to set apart and allot said property hereinbefore mentioned to her and her said minor child as exempt from administration.  Respectfully submitted. her as the widow of Z. T. Carpenter deceased, and Irene Carpenter, the only minor child of said deceased.
"J. S. J. Robertson and Alfred Shadix, the commisioners heretofore appointed and commissioned in this cause to set apart homestead to said widow and minor child, have on this the 14th day of February 1910, filed in this Court their report in writing setting apart to them as prayed for in petition, filed in  this Court on the 12th day of February 1910, the following described real estate as a homestead, to-wit: S1/2 of SW1/4 and NW1/4 of SW1/4 less 5 1/2 acres on west side of said last named forty in Section 21, Township 19, Range 8. "This cause coming on to be heard on this the 17th day of March 1910, and it  appearing to the Court from the petition and the evidence adduced in support of same, and from the report of the Commissioners, J.S.J. Robertson and J.A. Shadix who were on the 12th day of February 1910, duly appointed and commissioned to set apart homestead to Mrs. M.T. Carpenter, the said widow,  and minor child, Irene Carpenter, and filed in this cause on the 14th day of February 1910, that Z.T. Carpenter deceased, who departed this life on or  about the 10th day of August 1908, left surviving him the petitioner, Mrs. M.T. Carpenter, his widow, and Irene Carpenter, his only minor child at the time of his death, and that at the time of his death, he owned and was residing upon with the said M.T. The total number of acres owned by decedent being 116 acres more or less, and that he died seized and possessed of said described lands all of said described lands being situated in Clay County,  Alabama.  And it further appearing to the Court that there has been  no administration of the estate of Z.T. Carpenter deceased, and that no exceptions have been filed by any of the heirs at law of the said Z.T.
Carpenter deceased, in this cause, and more than thirty days have elapsed since the report of the said commissioners was filed, in this Court, in this cause, and that said commissioners did set apart the said described real estate as an exempt homestead to the said Mrs. M.T. Carpenter, the widow of said decedent, and Irene Carpenter, the only  minor child of Z.T. Carpenter at the time of his death, and that said described real estate, or lands, do not exceed in area 160 acres and did not at the time of the deat of the said Z.T. Carpenter exceed in value $2000.00, but was of the value at such time $1000.000, and that said widow and said minor child are entitled to said real estate hereinbefore described as a homestead.  And it further appearing that said real estate so set apart to said widow and said minor child, constituted all the real estate left by the said Z.T. Carpenter deceased, at the time of his death, and that he did not own any right title or interest in any other  real estate other than that set apart to said widow and said minor child by said commissioners, and that said real estate was less in value than $2000.00., and less in area than 160 acres.  It is therefore considered, ordered, adjudged and decreed by the Court that said real estate, hereinbefore described and set apart to said widow and minor child as a  homestead by said commissioners, be, and it is hereby set apart to Mrs. M.T. Carpenter, widow of Z.T. Carpenter  deceased, and Irene Carpenter the only minor child of said deceased, as a homestead, and they have and hold under the law of Alabama an absolute title in fee simple to same, and that all the right, title, interest and estate which the said Z.T. Carpenter deceased, had and held in and to said described real estate at the time of his death vests absolutely in Mrs. M.T. Hi, to all,
I finally went to the Health Department today and got the death certificate for Martha "Mattie" Carpenter, wife of Zachariah Thomas Carpenter.  These are the parents of John Warren Carpenter.
She is listed as Martha Teaugue Carpenter.  She was born on November 4, 1850, and died on November 21, 1930 at 7:15 p.m.  Cause of death is listed as acute indigestion -- probably a heart attack.  Her father is listed as Henderson Johnson.  and he is listed as being born in Clay County.  The mother's maiden name is not known.  She was buried on November 23, 1930, at Concord.
This still presents a dilemma of sorts.  Was her maiden name Martha Teague Johnson?  Or Was she married before, hence Martha Johnson Teague?  Sure wish I could find the marriage license.

George H. Carpenter -- I do not have him listed as a child of Zachariah
Thomas Carpenter and Martha J. Teague Johnson.  In fact, I don't
have him listed for any of the Carpenters.  That doesn't mean he was the
child of Zachariah and Mattie, just that I have never hear of him.

Upchurch, Nan Powell, and C.R. Carpenter, and in case of the death of any of my
heirs before my death, their heirs shall take such share as my heir would take,

and testament, and that he shall not be required to make bond for his acts and
duties, as executor of this, my last will and testament.

must have a settlement of same at once.  Your son from Miss. told us that he
was coming back here this fall and would pay this matter but we understand that
he is not coming.  So we must arrange this matter some way. We do not wish to
take legal action and incur further cost but will be forcd to do so unless we
get it arranged at once.  Thanking you in advance for looking after this

   I am Walter Lorenzo Carpenter b. 1943 in Hattiesburg, MS s/o Charles =

marriage license but it does not list her father.  It was issued in Clay =

residence of the bride's father in Clay Co. Ala.  My father Charles =
Phillip Carpenter was b. Jan. 11th 1909 on Sand Mt. near a community =

   When I was 11 yrs. old my grandmother Joanna told me her father was =
in the Civil Warr.  She showed me  medals he had and a banner from 5th =

   Warren L. Carpenter's parents were:  David H. Carpenter b. 1850 d. =
1922 m. to Nancy Bartlett d. 1878.  They lived in Ashland, AL and were =
members of Macedonia Primitive Baptist church in Ashland.  After Nancy =
died, David m. Jane Harris.
   David H. Carpenter's parents were:  Warren Carpenter m. 1832 to =
Sallie Harlan.  Moved from Henry Co. GA to Clay Co. Ala in 1850.  Lived =
6 mi. from Macedonia Church.  Were life-long members there.  Have copy =
of article from May 1911 edition of Primitive Baptist that she wrote at =
age of 91.  She was a member there for 60 yrs.
   I have original will from Clay Co. Ala of D.H. Carpenter Aug. 1920.  =
Shows children as:  Viola Elliott, Sallie Burough, Bulah Sparks, Lorenzo =
Carpenter, Synthia Hampton, Cora Morrison, Emmie Upchurch, Nan Powell,  =
Cephus Carpenter.  These would be Warren Lorenzo's brothers and sisters.
   I  do not have family Bible or know who does.  I have not looked up =
census 1900 or 1910 Clay Co. records.  I did go to Ashland July 1998 to =
courthouse.  Did not find census records.  Told census records were in =
Anniston, Ala library.  Have not checked on this.
   Sorry that this is so long, but I did not want to leave out any =
information that I was aware of.  Your information has been most helpful =
