Clayton Edison Roe

Monday 12 Sept 1927 Times Recorder, Zanesville, Ohio
Woodsfield, O., Sept. 11 - Attorney J. G. Devaul announced that amotion for a new trial would be filed Tuesday for Clayton Edison Roe,aged 28, who was found guilty by a jury Saturday of murdering DentWehr, near Calais, O. last April.  After deliberating 3 hours and 10minutes the jury returned a verdict of murder in the first degree, with a recommendation of mercy.
The motion for a new trial will also include the contentions that thecourt erred in the examination of prospective jurors, and that thecourt erred in rejecting evidence offered by the defense and objectedto by the state at the time of the trial, Attorney Devaul said.
Defense counsel stated that a new trial would be asked on the groundsthat errors of law were permitted to occur during the trial of thesensational case.  "We will contend that Judge W. D. Richter of theMonroe county common pleas court showed prejudice in his charge to thejury, and that the court erred in rejecting evidence offered by thestate and objected to by the defense."  Attorney Devaul said tonight.
Three days must elapse before sentence can be imposed upon theconvicted slayer, but the filing of the action for a new trial willautomatically halt this final procedure set for Wednesday.Prosecuting Attorney John K. Sawyers, who represented the case duringthe murder trial, left Saturday night for Maryville, Mo., to visitrelatives, and is not expected to return to Woodsfield this week.  Theopinion was expressed tonight by defense attorneys that the motion fora new trial would probably not be disposed of until the prosecutorreturns here, or for at least ten days.
The case was given to the jury Saturday afternoon and the jurydeliberated slightly more than three hours. It was stated inWoodsfield tonight that four jurors were in favor of finding theaccused man not guilty, acquitting him on the ground of insanity. After several more ballots were taken the four jurors who werehesitating because of the insanity point, were finally won over, and afirst degree murder verdict was returned, with a recommendation ofmercy.
It was said here today that the people of Monroe county were generallywell satisfied with the verdict as little surprise was shown in thefirst degree verdict.  Two physicians, Dr. D. S. Walker, St.Clairsville and Dr. H. P. Gillespie, Woodsfield, both testified duringthe trial that they had examined the defendant and believed him to beinsane. The defense was seeking an acquittal on the insanity issue.
