Samuel S. Carpenter, died at the Mennonite Home, Maugansville, at 10 o'clock yesterday morning of complications, aged 80 years.
The following children survive: Samuel W. Carpenter, Cearfoss; Henry W. Carpenter, this city; Mrs. Joseph Martin, Mason-Dixon; Mrs. Justin Shank, Leitersburg; Amos Carpenter, Woodpoint, and Mrs. Clarence Shank, Marion, Pa.
The funeral will be held Friday with a short service at the Mennonite Home at 1 o'clock; the services will be conducted at Reiff Mennonite Church. Internment in cemetery adjoining.

Carpenter - Samuel Carpenter was born near Lititz, Pa., Mar. 11, 1851; died at the Mennonite Old Folks' Home, Maugansville, Md., Dec. 9, 1931; aged 80 y. 8 m. 28 d. He was in good health until Friday, Dec. 4, when he took his bed and one week later he was laid beneath the clods of the valley. He leaves 3 sons (Samuel W., Henry W., and Amos), 3 daughters (Mary, wife of Joseph Martin; Fannie, wife of Christian Shank; Mattie, wife of Clarence Shank), 37 grandchildren, 38 great-grandchildren, 1 sister (Catherine Ressler), and 1 brother (Oliver Carpenter). Funeral services were held at the Reiff Church by Bros. David Lesher and John Grove. Text, Psa. 104:23. Interment in adjoining cemetery.

Bio: Mrs. Mattie Carpenter Shank, 69, of Marion, Pa., died Friday evening at the Chambersburg Hospital following a short illness. She was born at Maugansville, daughter of the late Samuel and Anna Carpenter Shank. She was a member of Marion Mennonite Church. She is survived by her husband, Clarence S. Shank; two sons, Chester Ray, Scotdale, Pa. and Merle Aldus, Chambersburg Route 6; a daughter, Mrs. Charles Hunsecker, Marion; Eleven grandchildren; two sisters, Mrs. Joseph Martin, Mt. Wolfe; Mrs. C. J. Shank, Maugansville; half-brother, Henry Carpenter, State Line. Services will be held Tuesday morning at 10 o'clock from the Marion Mennonite Church. Bio: OBITUARY :CLARENCE S. SHANK, 80, who lived with his son and daughter-in-law, Mr. and Mrs. Merle A. Shank, Chambersburg R.D.6, died at 8:30 p.m. Tuesday at home. Mr. Shank had lived with his son and daughter-in-law for 13 years. He was born near Marion, a son of the late John L. and Elizabeth (Eshleman) Shank. He was a member of the Marion Mennonite Church. Mr. Shank had been engaged in farming most of his life but also had been employed at J. W. Myers and Company, Chambersburg. His wife, Mrs. Mattie (Carpenter) Shank, died in 1962. Surviving are his son, Merle A. Shank, Chambersburg R.D. 6, and a daughter, Mrs. Charles E. Hunsecker, Marion, 11 grandchildren and four great-grandchildren. He was the last survivor of his immediate family. Services will be held at 10 a.m. Friday at the Marion Mennonite Church, in charge of Bishop Merle Cordell, Bishop Amos Martin and Ministers Allen Fleagle and Harry Funk. Burial will be made in the cemetery adjoining the church. Friends may call at the Minnich-Miller Funeral Home, Greencastle, Thursday from 7 to 9 p.m. and at the church one hour before the services. With an academic education at the age of 18, he started the stud y of law in the office of Emanuel C. Reigart, Esq. and was admit ted to the bar in November, 1843. In the December following he m oved to Cincinnati.
In 1849, he was appointed United States Commissioner by the U. S . Circuit Court. In a certain case before him, he made a histori c decision. In the Cincinnati Gazette on June 15, 1854, he publi shed an opinion stating at length his views on the constitutiona lity of the "Fugitive Slave Law" which were substantially that t he Commissioners were not courts within the terms and meaning o f the Constitution, not having the requisites of courts and ther efore could not exercise judicial powers conferred upon them; th e final decision of the question of a man's freedom or slavery f or life, without appeal, being in his opinion, the exercise of j udicial power in the highest sense.
Mr. Carpenter was the first United States Commissioner to declin e to execute the obnoxious law. He did not resign office but a s a result of his decision was the loss of his business as Commi ssioner which constituted a considerable portion of his professi onal income.[ZIMMERMANCARPENTER.ged]
